Terms of service.
Upon accepting a quote from The Clever Pen, the following terms and conditions are implicitly agreed.
Fees, Charges and Payment.
The Clever Pen charges on a per-project basis.
Once a brief has been completed, The Clever Pen will prepare a quote based on the time required to research, write and proofread your project.
All quotes are valid for 21 days.
Quotes include:
Research
Initial draft
2 amendment drafts
Final proofread
Unless specified in the initial quote, the fee does not include meetings with designers, web developers or agencies.
The Clever Pen reserves the right to requote a project if the client requires such meetings, further revisions, or sizeable changes to the brief.
Once a quote has been accepted, a non-refundable 50% deposit is required. Once received, The Clever Pen will schedule your project.
The Clever Pen requires a balance of payment within seven days of approving the final draft. Should payment not be received, The Clever Pen retains copyright for all work created. The client or any third party may not use the content.
Privacy and Confidentiality.
All correspondence, materials supplied, and work created by The Clever Pen will be kept strictly confidential.
The client agrees to indemnify The Clever Pen for any claim for compensation or damages resulting from accidental disclosure or loss of information.
Approval and Sign Off.
The Clever Pen asks that one person be nominated as the primary contact to ensure consistency throughout revisions.
Clients will receive seven days to submit revisions to the initial draft and subsequent amendment drafts. If modifications have not been received within the specified time frame, The Clever Pen will assume that the project has been approved. It will then be finalised and an invoice issued.
Intellectual Property, Liability, Release and Indemnity.
Content created remains the intellectual property of The Clever Pen until final payment is received.
Extracts of content created may be used after sign off for promotion unless specifically asked not to do so.
The Clever Pen assumes that all information provided by the client is factual and accurate.
The client indemnifies The Clever Pen from any claims or costs that may arise from error.
It remains the responsibility of the client to submit all copywriting for legal review where required.
